Warning period over: Drivers will soon face $50 fine for using phone while driving

Drivers across the region are being warned. 

Starting June 5, 2026, using a handheld phone behind the wheel could cost you. Under Pennsylvania’s new Paul Miller’s Law, motorists are prohibited from using handheld devices while driving, even if stopped at a red light, in traffic, or during other delays. After a warning period, enforcement is now set to begin, with violators facing a $50 fine plus court costs and fees.

Officials from the Pennsylvania Department of Transportation and local departments say they will begin issuing citations as the law goes into full effect.

"This means drivers cannot hold their phone or other devices while driving, even at a red light or stop sign," the Lower Gwynedd Police Department said. "Drivers will be given warnings until June 5, 2026. After June 5, 2026 driver’s may be issued citations for the violation."

The law still allows drivers to use hands-free technology for calls, GPS, and music, as well as to contact emergency services when necessary. However, any handheld use, including texting, scrolling, or dialing, while operating a vehicle is now illegal.

Authorities are emphasizing that penalties can go far beyond fines. In serious cases, distracted driving can lead to charges such as homicide by vehicle or aggravated assault by vehicle.

The law is named after Paul Miller Jr., who was killed in a crash caused by a distracted driver. State officials say the goal is to prevent similar tragedies.

According to PennDOT, nearly 10,000 crashes involving distracted drivers occurred statewide in 2024, resulting in thousands of injuries and dozens of deaths.

Local residents are urged to take simple precautions, including putting phones out of reach while driving, using “Do Not Disturb” mode, or pulling over safely if a message cannot wait.

With enforcement beginning soon, officials say the message is clear: put the phone down or pay the price, and potentially much more.
